This privacy policy ("Policy") describes how the personally identifiable information ("Personal Information") you may provide on the berenize.com website ("Website" or "Service") and any of its related products and services (collectively, "Services") is collected, protected and used. This Policy is a legally binding agreement between you ("User", "you" or "your" or “Buyer”) and BERÉNIZE ("BERÉNIZE", "we", "us" or "our") or the Society GWELLE di Gaia Pappi (“The Society”) (CHE-454.252.125). By accessing and using the Website and Services, the User/Buyer acknowledge that have read, understood, and agree to be bound by the terms of this Agreement. This Policy does not apply to the practices of companies that the Society do not own or control, or to individuals that the Society do not employ or manage.
In addition to this document, by accessing and using the Website and Services, the User/Buyer acknowledge that have read, understood and agree to be bound by the terms of the General Terms and Conditions.
Automatic collection of information
When the User/Buyer open the Website, the Society’s servers automatically record information that the the User/Buyer browser sends. This data may include information such as the User/Buyer device's IP address, browser type and version, operating system type and version, language preferences or the webpage the User/Buyer were visiting before the the User/Buyer came to the Website and Services, pages of the Website and Services that the the User/Buyer visit, the time spent on those pages, information that the the User/Buyer search for on the Website, access times and dates, and other statistics.

Processing your Personal Information depends on how you interact with the Website and Services, where the the User/Buyer are located in the world and if one of the following applies: (i) the the User/Buyer have given the consent for one or more specific purposes.
Note that under some legislations the Society may be allowed to process information until the the User/Buyer object to such processing (by opting out), without having to rely on consent or any other of the following legal bases below. In any case, the Society will be happy to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Information is a statutory or contractual requirement, or a requirement necessary to enter into a contract.
Billing and payments
In case of services requiring payment, the Society request credit card or other payment account information, which will be used solely for processing payments. User/Buyer purchase transaction data is stored only as long as is necessary to complete User/Buyer purchase transaction. After that is complete, the User/Buyer purchase transaction information is deleted. Where necessary for processing future payments and subject to your prior consent, User/Buyer financial information will be stored in encrypted form on secure servers of the Society reputed payment gateway service provider who is beholden to treating User/Buyer Personal Information in accordance with this Policy. All direct payment gateways adhere to the latest security standards as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. Sensitive and private data exchange happens over a SSL secured communication channel and is encrypted and protected with digital signatures, and the Website and Services are also in compliance with PCI vulnerability standards in order to create as secure of an environment as possible for Users. Scans for malware are performed on a regular basis for additional security and protection.
PayPal Payment Policies
Berénize (the Society) are committed to providing the User/Buyer with secure and convenient payment options. To ensure a seamless shopping experience, the Society have established the following payment policies when using PayPal as a payment method:
The Society accept payments through PayPal. The User/Buyer can use PayPal account or pay with a credit or debit card linked to PayPal account.
The Society do not store or have access to User/Buyer financial data, ensuring the security of User/Buyer transactions.
Payment Process: When selecting PayPal as the payment method on Society’s website, the User/Buyer will be redirected to the secure PayPal platform.
User/Buyer log to his PayPal account or provide his card details to complete the transaction.
When the user/buyer chooses to pay by credit card, it will be processed through the SHOPIFY payment system.
Once the payment is completed, the User/Buyer will receive a confirmation email of the transaction.
Returns & Refunds: Return and refund policies are governed by our general policies (general conditions). In case of return of products and according to the general conditions, the corresponding amount will be refunded via PayPal.
Please note that refunds may take several business days to process and appear in your PayPal account.
Cancellations: If a case of cancellation is given according to the general rules, the Society will refund the amount via PayPal or Credit Card as established in the general conditions.
Pending Payments: If a payment made through PayPal remains pending or is declined for any reason, the society will contact the User/Buyer to resolve the situation.
Security and Privacy: User/Buyer security is priority of the Society. PayPal uses advanced encryption technology to protect User/Buyer r financial data.
The Society will not share or store your payment information on Society’s website.
The society are not responsible for any issues related to the use of PayPal portals. If the User/Buyer have any problems with this service, the User/Buyer should contact PayPal's customer service directly.
Changes to Payment Policies: The Society reserve the right to make changes to these payment policies at any time. Any modifications will be notified through Society’s website.
By choosing to use PayPal as a payment method the User/Buyer accept and agree to these payment policies. If the User/Buyer have any questions or concerns regarding your payments through PayPal, please do not hesitate to contact the Society.
Managing information
The User/Buyer are able to delete certain Personal Information that the Society have about the User/Buyer. The Personal Information that the User/Buyer can delete may change as the Website and Services change. When the User/Buyer delete Personal Information, however, we may maintain a copy of the unrevised Personal Information in the Society records for the duration necessary to comply with Society’s obligations to Society’s affiliates and partners, and for the purposes described below.
Disclosure of information
Depending on the requested Services or as necessary to complete any transaction or provide any service the User/Buyer have requested, the Society may share User/Buyer’s information with User/Buyer’s consent with our trusted third parties that work with the Society, any other affiliates and subsidiaries that the Society rely upon to assist in the operation of the Website and Services available to the User/Buyer. The Society do not share Personal Information with unaffiliated third parties. These service providers are not authorized to use or disclose User/Buyer’s information except as necessary to perform services on our behalf or comply with legal requirements. In the event the the Society go through a business transition, such as a merger or acquisition by another company, or sale of all or a portion of its assets, User/Buyer’s account, and Personal Information will likely be among the assets transferred.
To facilitate worldwide shipping, we may share necessary personal information (such as name, shipping address, and order details) with customs authorities and relevant regulatory agencies. This ensures compliance with international import/export laws and enables smooth delivery of orders. When shipping internationally, your personal data may be processed to determine applicable customs duties, VAT, or other import taxes required by your country’s regulations.
Retention of information
The Society will retain and use User/Buyer Personal Information for the period necessary to comply with Society’s legal obligations, resolve disputes, and enforce our agreements unless a longer retention period is required or permitted by law. The Society may use any aggregated data derived from or incorporating User/Buyer’s Personal Information after the User/Buyer update or delete it, but not in a manner that would identify the User/Buyer personally. Once the retention period expires, Personal Information shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after the expiration of the retention period.
Transfer of information
Depending on the User/Buyer location, data transfers may involve transferring and storing User/Buyer’s information in a country other than User/Buyer’s own. The User/Buyer are entitled to learn about the legal basis of information transfers to a country outside the European Union or to any international organization governed by public international law or set up by two or more countries, such as the UN, and about the security measures taken by the Society to safeguard User/Buyer’s information. The rights of users
The User/Buyer may exercise certain rights regarding his information processed by the Society. In particular, the User/Buyer have the right to do the following: (i) the User/Buyer have the right to withdraw consent where the User/Buyer have previously given User/Buyer consent to the processing of User/Buyer’s information; (ii) User/Buyer have the right to object to the processing of User/Buyer’s information if the processing is carried out on a legal basis other than consent; (iii) the User/Buyer have the right to learn if information is being processed by the Society, obtain disclosure regarding certain aspects of the processing and obtain a copy of the information undergoing processing; (iv) the User/Buyer have the right to verify the accuracy of his information and ask for it to be updated or corrected; (v) the User/Buyer have the right, under certain circumstances, to restrict the processing of his information, in which case, the Society will not process User/Buyer’s information for any purpose other than storing it; (vi) the User/Buyer have the right, under certain circumstances, to obtain the erasure of User/Buyer’s Personal Information from the Society; (vii) The User/Buyer have the right to receive his information in a structured, commonly used and machine readable format and, if technically feasible, to have it transmitted to another controller without any hindrance. This provision is applicable provided that User/Buyer information is processed by automated means and that the processing is based on your consent, on a contract which User/Buyer are part of or on pre-contractual obligations thereof.
The right to object to processing
Where Personal Information is processed for the public interest, in the exercise of an official authority vested in us or for the purposes of the legitimate interests pursued by the Society, User/Buyer may object to such processing by providing a ground related to User/Buyer’s particular situation to justify the objection. The User/Buyer must know that, however, should User/Buyer’s Personal Information be processed for direct marketing purposes, User/Buyer can object to that processing at any time without providing any justification. If the User/Buyer are a resident of the European Economic Area (EEA), the User/Buyer have certain data protection rights and the Society aims to take reasonable steps to allow the User/Buyer to correct, amend, delete, or limit the use of his Personal Information. If the User/Buyer wish to be informed what Personal Information the Society hold about the User/Buyer and if the User/Buyer want it to be removed from Society’s systems, please contact the Society. In certain circumstances, the User/Buyer have the following data protection rights:

The User/Buyer have the right to complain to a Data Protection Authority about Society’s collection and use of User/Buyer Personal Information. For more information, the User/Buyer have to contact his local data protection authority in the European Economic Area (EEA).
Data protection rights under LDP Switzerland
If the User/Buyer is a resident of the Swiss Confederation, the User/Buyer have certain data protection rights.
The processing of data by the Society is in accordance with the provisions of the LDP. In particular, pursuant to the aforementioned law:

The Society process personal data (data that allows the direct or indirect identification of natural persons) that the Society collect ourselves or receive from the User/Buyer or third parties in the context of the use of Society’s platforms and services.

In such cases, the Society use certain IT services or means of communication that may pose data security risks. If the User/Buyer would like us to take special security measures, please let know to the Society. Otherwise, by accepting these provisions, the User/Buyer authorize the Society to use the services indicated above without any reservation. In the event of requests for special security measures, if they are not applicable, the User/Buyer will be notified immediately.

The above-mentioned objections are based on a legitimate interest in the processing of personal data. Some processing is also necessary to fulfil Society’s contractual obligations to the User/Buyer. The same applies to the legal obligations to which we are subject.

As a data subject, the User/Buyer have the right under the Law to obtain information about the personal data stored about the User/Buyer, to know the purpose, to rectify it, to erase it, to restrict the processing, to object to the processing and to contact the competent supervisory authority in addition to the general information set out below. The User/Buyer also have the right to data transmission and data portability. Please note, however, that these rights are subject to conditions and exceptions. To the extent that the law authorizes or requires it, certain requests may be rejected. Therefore, the Society may or must, in accordance with the LDP, possibly store personal data or continue to process it in any other way for legal reasons, despite a request for erasure or restriction of data processing.

How to exercise these rights
Any requests to exercise the User/Buyer rights can be directed to the Society through the contact details provided in this document. Please note that the Society may ask to the the User/Buyer to verify his identity before responding to such requests. The User/Buyer request must provide sufficient information that allows the Society to verify that the User/Buyer are the person that the User/Buyer are claiming to be or that the User/Buyer are the authorized representative of such person. The User/Buyer must include sufficient details to allow the Society to properly understand the request and respond to it. The Society cannot respond to User/Buyer’s request or provide User/Buyer with Personal Information unless the Society first verify User/Buyer’s identity or authority to make such a request and confirm that the Personal Information relates to User/Buyer.

The Society are committed to keeping User/Buyer’s e-mail address confidential and will not disclose User/Buyer’s email address to any third parties except as allowed in the information use and processing section or for the purposes of utilizing a third party provider to send such emails. Society will maintain the information sent via email in accordance with applicable laws and regulations.
In compliance with the CAN-SPAM Act, all e-mails sent from the Society will clearly state who the e-mail is from and provide clear information on how to contact the sender. User/Buyer may choose to stop receiving Society’s newsletter or marketing emails by following the unsubscribe instructions included in these emails or by contacting the Society. However, User/Buyer will continue to receive essential transactional emails.
Links to other resources
The Website and Services contain links to other resources that are not owned or controlled by the Society. Please be aware that the Society are not responsible for the privacy practices of such other resources or third parties. The Society encourage the User/Buyer to be aware when User/Buyer leave the Website and Services and to read the privacy statements of each and every resource that may collect Personal Information.
Information security
The Society secures the User/Buyer’s information provide on computer servers in a controlled, secure environment, protected from unauthorized access, use, or disclosure. The Society maintain reasonable administrative, technical, and physical safeguards in an effort to protect against unauthorized access, use, modification, and disclosure of Personal Information in its control and custody. However, no data transmission over the Internet or wireless network can be guaranteed. Data breach
In the event that the Society become aware that the security of the Website and Services has been compromised or users Personal Information has been disclosed to unrelated third parties as a result of external activity, including, but not limited to, security attacks or fraud, the Society reserve the right to take reasonably appropriate measures, including, but not limited to, investigation and reporting, as well as notification to and cooperation with law enforcement authorities. In the event of a data breach, the Society will make reasonable efforts to notify affected individuals if the Society believe that there is a reasonable risk of harm to the User/Buyer as a result of the breach or if notice is otherwise required by law. Changes and amendments
The Society reserve the right to modify this Policy or its terms relating to the Website and Services from time to time in Society’s discretion and will notify to User/Buyer of any material changes to the way in which the Society treat Personal Information. The Society may also provide notice to User/Buyer in other ways at Society’s discretion, such as through contact information User/Buyer have provided. Any updated version of this Policy will be effective immediately upon the posting of the revised Policy unless otherwise specified.
